Terms of use
These terms govern your use of the Helix mobile app ("the app") and the website at helixnetball.com ("the website"), provided by Richard Thornton (ABN 41 457 527 181) — "we", "us", "our". By using the app or the website, you agree to these terms. If you don't agree, please don't use them.
Who can use Helix
You must be able to enter into a binding agreement to use Helix. If you're under 18, you may use it only with the permission of a parent or guardian, who accepts these terms on your behalf.
Your licence
The app is free. We give you a personal, non-exclusive, non-transferable licence to use it for recording and reviewing match statistics. You may not sell, rent, sub-licence, copy, modify, reverse engineer or attempt to extract the source code of the app, except where the law says you may.
Your data and backups
Everything you record is stored only on your device. We hold no copy, can't access it, and can't recover it if it's lost. You're responsible for keeping your own backups — export and save the app's PDF summaries regularly. Uninstalling the app, resetting or losing your device, or a device fault may permanently erase your data. We aren't responsible for that loss (see Liability below).
Acceptable use
You agree to use Helix lawfully, and only to record information you have the right to record. You must not use it to break the law, infringe anyone's rights, or in any way that could harm Helix or other people.
What Helix is — and isn't
Helix is a tool for recording and reviewing statistics after a match. It isn't an official scoring, timing or officiating system, and it isn't a source of truth for any match result. You're responsible for the accuracy of what you record and for how you use it.
Availability and changes
We provide the app and website "as is" and "as available". We don't promise they'll be uninterrupted or error-free, and we may change, suspend or discontinue any part of them at any time.
Our intellectual property
The Helix name, branding, the app and the website — and everything in them, other than the data you record — are owned by us. These terms don't give you any rights to them beyond the licence above.
Australian Consumer Law
Our app and services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under that law.
Liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law guarantees above:
- we aren't liable for any loss or damage arising from your use of Helix, including lost, corrupted or unrecoverable data; and
- where our liability can't be excluded but can be limited, our total liability to you is limited, at our option, to re-supplying the app or paying the cost of having it re-supplied — and, as the app is free, won't exceed AUD 100.
Third-party services
You download the app through the Apple App Store or Google Play, and your use is also subject to their terms. We aren't responsible for those services.
Waitlist emails
If you join our waitlist, we'll email you about Helix as described in our Privacy Policy. You can unsubscribe at any time.
Privacy
Our Privacy Policy explains how we handle personal information and forms part of these terms.
Changes to these terms
We may update these terms from time to time; the current version always lives at helixnetball.com. If you keep using Helix after we update them, you accept the change.
Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the courts of that state.
