Terms of use
These terms are an agreement between you and Richard Thornton trading as HELIX Netball (ABN 41 457 527 181), a sole trader based in Victoria, Australia ("we", "us"). By using the HELIX app or website, you accept them.
1. What HELIX is
HELIX is a netball statistics recorder. You use it to record match events courtside and to review the statistics derived from them. It is a record-keeping and analysis tool — it is not an official scoring, umpiring or officiating system, and its output has no official standing in any competition.
2. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable licence to install and use HELIX on devices you own or control, for recording and reviewing your teams' statistics. You must not copy, modify, distribute, sell, reverse-engineer or create derivative works from the app, except where the law allows it regardless of this restriction.
The app is currently free. If paid features or organisational licences are introduced in future, they will be offered under their own terms.
3. Your data and your responsibility for it
All data you record in HELIX is stored locally on your device. We do not hold a copy and cannot recover it for you. You are responsible for safeguarding your own records — the app's export features (PDF and CSV) exist for this purpose, and we recommend exporting anything you cannot afford to lose. Deleting the app, or losing or resetting your device, permanently deletes the data on it.
4. Recording information about other people
HELIX lets you record names and playing statistics of real people, who will often be children or teenagers. When you do, you are the one collecting and holding that information — it stays on your device and we never receive it. You must only record information about others where you are entitled to do so, and you are responsible for complying with any rules your club, association or competition applies to the recording and sharing of players' information, particularly for junior players. Be considerate about who you share exported reports and team files with — a team file carries the player names of everyone in that squad.
5. Acceptable use
You must not use the app or website unlawfully, attempt to gain unauthorised access to our systems, interfere with their operation, or submit abusive, deceptive or unlawful content through the feedback or waitlist forms.
6. Intellectual property
The app, the website and the HELIX name, logo and branding are our property or used under licence, and are protected by intellectual property law. These terms give you no rights in them beyond the licence in section 2. The statistics and records you create from your own recorded data are yours.
7. Accuracy of statistics
Statistics shown in HELIX are derived from the events you record, including any edits, undo actions and score reconciliations you make. Their accuracy therefore depends on what was recorded. We do not warrant that derived statistics are error-free, and they should not be relied on as an official record of any match.
8. Availability and changes
We may update, change or discontinue features of the app or website at any time. Because your data lives on your device, discontinuation of any online service (such as the website or feedback delivery) does not affect your ability to record and review matches. Crash reporting and feedback delivery depend on network availability and third-party services and are not guaranteed to be available at all times.
9. Consumer guarantees, disclaimers and liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to that, the app and website are provided "as is" and, to the maximum extent permitted by law: we exclude all other warranties and guarantees; our total liability to you in connection with the app or website is limited, at our election, to resupplying the relevant service or paying the cost of having it resupplied; and we are not liable for loss of data, loss of opportunity, or any indirect or consequential loss — including loss of match records stored on your device.
10. Apple App Store terms
Where you downloaded HELIX from the Apple App Store, the following also applies: these terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support for the app; Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims; in the event the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund any purchase price paid (there is none — the app is free), and to the maximum extent permitted by law Apple has no other warranty obligation; you represent that you are not located in a country subject to a US Government embargo and are not on any US Government prohibited-parties list; and Apple and its subsidiaries are third-party beneficiaries of these terms, entitled to enforce them against you.
11. Termination
You may stop using HELIX at any time by deleting the app. We may suspend or terminate your access to the online services (website forms, feedback delivery) if you breach these terms. Sections 3, 4, 6, 7, 9 and 10 survive termination.
12. Changes to these terms
We may update these terms as the app changes. The current version is always at helixnetball.com/terms, with its effective date shown above. Continuing to use the app or website after an update takes effect means you accept the updated terms.
13. General
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts. If any part of these terms is unenforceable, the rest remains in effect. A failure to enforce a term is not a waiver of it.
